| Аннотация | В статье рассматривается круг вопросов, касающихся общих черт и особенностей международного и европейского права - права Ев- ропейского Союза. Во взаимоотношениях рассмат- риваемых правовых систем отмечается приоритет международного права по отношению к европейско- му. Сходные черты обеих правовых систем объяс- няются, прежде всего, общностью их юридической и социально-политической природы. Показано, что особенности взаимоотношений данных правовых систем, примат международного права над нацио- нальным проявляются на разных уровнях и в разных формах. В числе особенностей обращают на себя внимание источники права. Кроме общих источни- ков права, в каждой правовой системе используют- ся и свои собственные. Также большое значение приобретают общие и особенные элементы самого процесса формирования и функционирования рас- сматриваемых правовых систем. |
